What is a Life Care Plan?

A Life Care Plan can be used for personal injury, medical malpractice, work injury or any case where knowing the cost of future healthcare and medical treatment is critical. A well-written Life Care Plan is individualized for each person based on professional assessment and collaboration with the entire healthcare team. It provides a solid, defensible cost proposal for personal financial planning, mediation, or trial.

 

A Life Care Plan begins with an in-person nursing assessment and evaluation of the injured individual's living environment.

 

Medicare Set Aside 

A focused Life Care Plan which allocates a portion of a settlement for future medical expenses. The amount of the set aside is determined on a case-by-case basis and should be reviewed by the Centers for Medicare and Medicaid Services (CMS), when appropriate. Once the CMS determined set aside amount is exhausted and accurately accounted for to CMS, Medicare will agree to pay primary for future Medicare covered expenses related to the injury. 
 
Medical Cost Projection 

A focused Life Care Plan addressing future medical needs based on medical records and communication with providers of care.  The Medical Cost Projection includes components of a full life care plan, but is provided in a more concise format.  It is often used to assist an insurance adjustor with reserve-setting or to assist an attorney to obtain a ball-park figure for settlement of an uncomplicated injury.
